For purposes of the HST, certain persons will be deemed to be resident in a particular province in specified circumstances. These rules will be based on the deeming rules contained in subsection 132(1) of the Excise Tax Act. For example, a corporation will be deemed to be resident in a particular province if it is incorporated in that province. In addition, for some purposes, as noted in this paper, the residence of an individual will be deemed to be the individual's mailing address. Also, a person will be regarded as resident in a particular province if the person has a permanent establishment in that province. Finally, a person may be regarded as resident in a particular province based on general legal principles.

If you are resident and ordinarily resident in the UK according to the Inland Revenue's definitions, even if you spend a lot of time as an expatriate, you are still liable to UK income and capital taxes. If, however, you can manage to achieve the status of non-resident and not ordinarily resident you can avoid income tax and capital gains tax for each of the tax years (which run from 6 April to the next 5 April) that you are away from the UK. The most basic definition of a UK resident is someone who visits the UK for six months in a tax year, but there are other rules and definitions based mainly on Inland Revenue practice rather than chapter and verse of the law. Tax advice may be necessary if you are unsure of your position.
For inheritance tax purposes, residence has the same meaning as for income tax purposes. To be regarded as resident in the UK you must normally be physically present in the country at some time in the tax year. You will always be resident if you are here for 183 days or more in the tax year. More information about this can be found in the booklet IR20.
You are resident in the UK if you spend at least half the tax year in the UK, or if you spend at least three months per tax year in the UK on average. You may be resident in the UK if you spend less time in the UK, but you will not be resident if you have not been in the UK at all during the tax year.

The owner of a "Residencia" is a resident. Since Spain became a EC-member the "Schengen Convention" makes it is clearly illegal to ask all foreigners which are staying longer than 90 days on Spanish territory to apply for Residencia. The political discussions about this are controversial but sooner or later Spain will need to give up this habit. In everyday life the Residencia is hardly ever inspected nor necessary for any transactions. Only when you buy ferry or plane tickets amongst the Canary Islands or from here to the mainland of Spain you pay clearly lower prices as a resident.

The amount of tuition a student pays to a public (state-supported) college is determined by the student's state residence status. If a student is a resident of the state, then the student pays a lower tuition rate. A non-resident will pay a higher tuition rate. Residency requirements vary from state to state but are determined by where a student's parents live and if the student is younger than a certain age. Tuition rates for private colleges are not based on residency.
