Names often used in conducting a business, or during a lawsuit when that persons name is not known or when it is appropriate to conceal the true name of the party.
A business name other than that of the person under whom the business is registered. Most state license laws require such brokerage offices operating under an assumed name be jointly registered under the supervising broker's name and the fictitious business name.
A name other the entity's true name, under which an individual or business entity conducts business. Also referred to as an assumed name, a trade name or "doing business as" (D.B.A.).
A name that does not include the surname of the individual owner and each of the partners or clearly reveal the nature of the business.
a declaration by an individual or other business entity stating that they intend to conduct their business under the name they have chosen
a legal alias for an individual, or in rare cases for a legal entity operating under a different name
a name other than the legal name of a corporation or other business owner under which that owner operates or intends to operate its business
a name that does not include the surname of the individual or a name that suggests the existence of additional owners
or Assumed Name or Trade Name or d/b/a
A fictitious business name is used when the trade name is different from the legal name of the entity (individual, partnership, LLC, or corporation) that owns the business. For example, if Frank Farmer called his sole proprietorship "American Appliances," "American Appliances" would be considered a fictitious name because it does not contain the owner's last name. A fictitious business name is sometimes referred to as a d/b/a (doing business as) name. Fictitious business names must be registered.
The name, other than that of the owner, under which a business is conducted which must be filed with the county clerk.
A company whose operating name differs from its legal name is said to be doing business under a fictitious business name. Some states require DBA (doing business as) or fictitious business name filings to be made for the protection of consumers conducting business with the entity.
