Under the new legislation, claims to enfranchise the freehold of a building collectively would have to be made using the vehicle of a RTE company which all lessees would have a legal right to join. This is intended to overcome the problem associated with the existing system where self-selecting groups of lessees could act together and exclude other lessees from participating in an enfranchisement claim. However, difficulties over the drafting of the necessary regulations have cast some doubt over when, and indeed if, this element of the Act will come into force. For the time being, therefore, the "nominee purchaser" continues as the vehicle for a collective enfranchisement.
