Definitions for "Last clear chance"
A doctrine that liability may attach to a person who, immediately before an accident, had a last clear chance to avoid it and did not. (LE)
A valid counter-defense to contributory negligence when the defendant had the "last clear chance" to avoid injury or the defendant could have prevented the injury, but failed to do so.
Argument in a negligence action which holds that the defendant with the last clear chance to avoid the accident is guilty of contributory negligence by failure to use that last clear chance.
