Proposed: In Boone, Campbell and Kenton Counties, the state is proposing to use the IM 240 test. The Louisville area is proposing to use a loaded-mode, ASM test. No implementation dates set for either area.

School boards may authorize the voluntary recitation of the Lordâ€(tm)s Prayer and Pledge of Allegiance in public schools; students shall be informed that the recitation is not for purposes of molding the belief of students, but rather to remind students of their American liberties, including the freedom of religion. Ky. Rev. Stat. Ann. Â§ 158.175(1) (2005). The next section of the same statute mandates that each public school student be given the opportunity to recite the Pledge of Allegiance at the beginning of each school day (students who do not wish to recite the Pledge may remain in their seats). The case is intended to decide if BellSouth's network unbundling obligations under Sec. 271 require it to provide Ky. CLECs with certain unbundled network elements ("UNEs") delisted from Sec. 251 by FCC Triennial Review actions.

Electric competition studies have been conducted by the Electricity Restructuring Task Force, which was established in 1998. The study urges against retail choice since electric prices are so low, but the task force will continue to monitor the issue. The task force believes customers would end up paying more over the next ten years for electricity because utilities would have to incur the additional cost of complying with federal environmental regulations.
Kentucky's high-risk pool, Kentucky Access, became operational in 2001 and is financed by program participant premiums, tobacco settlement funds, and assessments on insurers. The programs premium cap is set at 175 percent. As of May 2005, approximately 3,300 persons were enrolled in the program.
