The document which a sponsor signs in order to petition a family member for legal permanent residence through a family based visa. Any affidavit signed after December 19, 1997 is a legally binding promise to support the immigrant in case of financial crisis until s/he has become a citizen or has accumulated 10 years of work credit in the U.S. Sponsors may be required by the state or federal government to reimburse certain public benefits used by the immigrant during this time.
All persons seeking an immigrant visa based on family or employment must file this form (I-864). The sponsor must earn at least 125% of the federal poverty level for the total number of persons in the household, and/or have a certain amount of assets. The Affidavit of Support legally commits the sponsor to support the immigrant until the immigrant becomes a U.S. citizen, has 40 quarters of work, dies, or permanently leaves the United States. The sponsor must also pay back certain public benefits received by the immigrant (like Food Stamps, Medicaid, SSI and TAFDC).
A document promising that the person who completes it will support an applicant financially in the United States. Family and certain employment immigration cases require the I-864 Affidavit of Support, which is legally binding. All other cases use the I-134 Affidavit of Support.
The form used by a Sponsor to allow an immigrant to qualify for the green card. All family immigrants must have a sponsor execute and submit an Affidavit of Support. to show that the immigrant is not likely to need welfare or other public payments. The Sponsor signing the Affidavit of Support (Form I-864) is obligated to repay support benefits received by the immigrant for up to 10 years and even a divorce does NOT end the obligation.
