An outstanding claim on a property that prevents the legal sale of that property. Also known as a Cloud on the title. A title with defects is not a "clear" title.
An outstanding claim or encumberance on property that affects marketability
(1) Any possible or patent claim or right outstanding in a chain of title that is adverse to the claim of ownership. (2) Any material irregularity in the execution or effect of an instrument in the chain of title.
Any legal right to a property claimed by a person other than the owner. Examples include unpaid real estate taxes, a judgment lien against a prior owner, or claims to the property by an unknown heir.
