Definitions for "Incapacitated Person"
a person who has been judicially determined to lack the mental capacity necessary to manage at least some of his or her property or who cannot provide for his or her own health and safety
Under one statutory definition, an incapacitated person means any person who is impaired by reason of mental illness, mental deficiency, mental disorder, physical illness or disability, chronic use of drugs, chronic intoxication or other cause, except minority, to the extent that he or she lacks sufficient understanding or capacity to make or communicate responsible decisions concerning his or her person.
A person who has been judicially determined to lack the capacity to manage at least some of the property or to meet at least some of the essential health and safety requirements of such person.
